In short
- Timstrok connects candidates and companies on professional criteria. The candidate’s name, photo and contact details are revealed only after mutual interest, and a person at the company always makes the hiring decision.
- The service is free of charge for candidates. During the closed test it is also free for companies; afterwards, their subscriptions will be governed by the terms of sale.
- You remain the owner of your content. You can report content, challenge a decision and close your account at any time.
01Definitions
In these terms, the following words have the meaning given below:
- Timstrok or we: the Timstrok service and its publisher, identified in the legal notice;
- you or user: any person who has an account;
- candidate: the user who is looking for a job;
- company: the employer (company, association, sole trader, public body…) that recruits through a company space;
- member: the user authorised to act in a company space;
- content: any information published or sent by a user, such as a profile, a CV, a photo, a job offer, a message or an attachment;
- mutual interest: the moment when the candidate and the company have each expressed their interest, which opens the connection (“match”).
02Purpose, acceptance and contracting party
These terms of use govern the use of Timstrok, on the timstrok.com website and in the mobile apps. Your contracting party is the publisher, Simon Kortsmit. You accept them when you create your account; they apply for as long as you have one.
Timstrok is neither your employer nor a party to the employment contract. We guarantee neither a hire nor a number of answers or applications.
Company subscriptions are governed by the terms of sale. The processing of your data is described in the privacy policy.
Transfer to the operating company. The publisher intends to entrust the operation of Timstrok to a company that he will set up. You agree now that these terms, together with the data needed to perform them, may be transferred to that company (Article 1216 of the French Civil Code), which will then become your contracting party and the data controller. We will inform you at least 30 days in advance, with its identity; if you refuse the transfer, you may close your account before it takes effect.
03Closed test
Before it opens to the public, Timstrok is offered free of charge, by invitation, to a limited number of people and for a limited period. During this closed test:
- only invited e-mail addresses can create and use an account; withdrawing an invitation ends access;
- no subscription is sold: orders, payments and company verifications are fictitious and have no legal or financial effect;
- the service may change, be interrupted or contain defects; please report them through the support form.
When the service opens to the public, your account and your data are kept. We will then present the applicable terms to you: you will accept them to continue using the service, or you may close your account. If Timstrok does not open to the public, we will close the service and delete the accounts and their data within 30 days of closing it.
Your feedback on the service helps us improve it. You allow us to use it freely and free of charge to develop Timstrok, without ever reusing your personal data.
04Your account
Registration is open from the age of 16; you confirm it when you create your account. Under 18, you need the consent of your legal representatives to use Timstrok and to enter into an employment contract; they may ask at any time for your account to be closed through the support form.
You provide accurate and up-to-date information, keep your sign-in methods secret and only use your own account. Tell us without delay about any use you did not authorise.
To act on behalf of a company, you must be authorised to do so. The administrators of the company space grant and withdraw members’ access. An identity or company verification confirms the verified identity, not the accuracy of all published content.
05How matching works
Timstrok compares the criteria of CVs (positions, experience, education, skills, certifications, languages, driving licences, location, remote work, pay, availability) with those of job offers. The calculation is deterministic: it applies known rules and thresholds, without artificial intelligence or machine learning, and does not measure anyone’s professional worth.
The mandatory criteria of an offer must be met; the others increase compatibility. An unmet mandatory criterion, or a threshold chosen by the candidate or the company, may automatically exclude a profile from an offer. You may ask which criteria excluded your profile, express your point of view and obtain a new review by a person by writing to support.
Before mutual interest, the company sees a profile without name, photo, telephone number or address. The connection opens only when the candidate and the company have each expressed their interest. The decision to hire always rests with a person at the company.
The ranking of offers and profiles does not depend on any payment: a larger subscription increases the number of active offers and accounts, not an offer’s place in the results.
In accordance with Articles L1221-8 and L1221-9 of the French Labour Code (Code du travail), these methods are disclosed to you before they are used. The data used is described in detail in the privacy policy.
06AI-assisted import
Only at your request, a document you import (your CV or, in a company space, a job description) is read by an artificial intelligence service, Mistral AI, to pre-fill your profile or a draft offer, which is never published automatically.
The result may contain errors: you check it before saving it and you remain responsible for what you publish. This import does not rank, score or exclude any candidate. How it works and how documents are kept are described in the privacy policy.
07Commitments of companies
- Publish real, available and accurate offers (position, pay, location, type of contract), written in French when the work is performed in France, with no age limit and no discriminatory criterion, unless there is a genuine and determining occupational requirement (Articles L1132-1, L1133-1 and L5331-2 to L5331-4 of the French Labour Code; Articles 225-1 and 225-2 of the French Criminal Code).
- Only ask a candidate for information directly and necessarily linked to the position offered (Article L1221-6 of the French Labour Code).
- Use candidates’ data only for legitimate recruitment, within the stated limits; control access, exports and how long their files are kept, and answer candidates’ requests about how their data is used.
- Write relevant, factual and respectful internal notes.
- Never ask a candidate for money, in any form, to access a recruitment process.
08What is prohibited
- Fictitious or misleading offers, fake profiles and identity theft.
- Discrimination, harassment, threats, hate speech and content that infringes the rights of others (privacy, image, intellectual property).
- Solicitation unrelated to recruitment, abusive canvassing, and reselling or disclosing profiles outside Timstrok.
- Automated or large-scale extraction of data, circumventing access controls, reverse engineering and any attempt to disrupt the service.
09Your content
You keep your rights to your texts, photos and documents. You grant us, free of charge, on a non-exclusive basis, worldwide and only for as long as they are published, the right to store them, to reproduce and technically adapt them (format, size, compression) and to show them to the recipients you have chosen, according to the visibility you have set. This right allows neither their sale, nor their transfer to a third party, nor any advertising use.
You warrant that you hold the necessary rights to what you publish (photos, logos, texts) and that your content complies with the law and these terms.
This right ends when the content is removed or the account is deleted, except for the copies needed to comply with a legal obligation, to defend legal claims or for exchanges already shared with other users. Personal data is kept as set out in the privacy policy.
10Timstrok’s intellectual property
The Timstrok name, its logo, the software, the database and the editorial content of the service are protected by the French Intellectual Property Code. We grant you a personal, free, non-exclusive and non-transferable right to use the service for your own needs and in accordance with these terms. Any other reproduction, communication or extraction is prohibited without our written permission.
11Reporting content and challenging a decision
To report content that you consider illegal or contrary to these terms, use the support form with the “Content report” category, even without an account. State the exact location of the content, the reasons why you consider it illegal and a way to reply to you, and confirm that your report is made in good faith.
We acknowledge receipt of every report. It is examined by a person, diligently and objectively; no moderation decision is taken by automated means. Depending on the seriousness, we may ask for a correction, limit the visibility of content, remove it, or suspend or close an account. Where there is an immediate risk, a precautionary measure may be taken without delay. The person who made the report is informed of the decision.
The person whose content or account is subject to a measure receives, at the latest when it applies, a statement of reasons: the measure taken, the facts relied on, the rule applied (law or these terms) and the available remedies, unless the law prohibits it. Within six months, they may ask for a new review by writing to support and providing any useful information; we reply with reasons.
Recourse to the courts remains open, as well as, where applicable, the out-of-court dispute settlement bodies certified under Article 21 of Regulation (EU) 2022/2065 on digital services.
12Measures in case of breach
If you do not comply with these terms, we may, in proportion to the seriousness of the breach: send you a warning, remove or hide content, suspend a feature or your account, or close your account.
Except in an emergency (danger to a person, fraud, serious harm to the rights of others) or where the law requires it, suspending or closing an account is preceded by a warning with reasons and a 15-day period to remedy the breach. A serious breach, such as a fictitious offer, discrimination, asking a candidate for money or identity theft, may lead to immediate closure. Every measure can be challenged as described above.
13Availability of the service
We use reasonable means to keep the service available, restore it after an incident and announce significant planned interruptions in advance. Interruptions may occur for maintenance, incidents or security; uninterrupted access to the service is not guaranteed.
14Liability
We are bound by an obligation of means (best efforts). We are not liable for:
- content published by users, which we host without checking it in advance; we act promptly to remove manifestly illegal content reported to us (Article 6 of Regulation (EU) 2022/2065);
- hiring decisions, exchanges between users, or the conclusion or performance of the employment contract, to which we are not a party;
- the accuracy of the information declared by users, including information read by the AI-assisted import.
If you are a consumer, these provisions limit neither your right to compensation if we fail to meet our obligations, nor the statutory guarantees you enjoy. If you act for a company, our liability is limited to direct and foreseeable damage and covers neither the loss of a chance to recruit nor loss of profit. No limitation applies in case of gross negligence or wilful misconduct, or to personal injury.
15Duration and closing your account
These terms apply for an indefinite period. You can delete your account at any time from the settings: access is cut immediately and you have 30 days to restore it by signing in again, before it is permanently deleted. The last owner of a company space must first transfer its ownership to another member; closing the space, which is requested from support, does not delete their account.
An account with no activity for 2 years is deleted after three e-mail reminders; a registration whose e-mail address has not been verified within 7 days is erased. The details are set out in the privacy policy.
Deleting a personal account does not terminate a company’s subscription: termination is done in the Subscription area, under the terms of sale.
16Changes to these terms
The version in force and its date appear at the top of this document. A significant change is submitted to you at your next sign-in and applies to you only once accepted; if you refuse it, you can close your account free of charge. A minor change, with no effect on your rights and obligations, applies as soon as it is published. No change is retroactive.
17Language, governing law and disputes
These terms exist in French, English, German and Dutch. The French version prevails; if you are a consumer, however, a translation difference that would be unfavourable to you cannot be relied on against you.
These terms are governed by French law. If you are a consumer residing in another Member State of the European Union, you keep the protection of the mandatory rules of that State.
In case of disagreement, first write to support: we reply within 30 days. If you are a consumer, consumer mediation is governed by Articles L612-1 et seq. of the French Consumer Code. During the closed test, which is entirely free of charge, no consumer mediator is appointed; their details will appear here as soon as the service opens to the public.
Failing agreement, the dispute is brought before the competent court under the ordinary rules. If you are a consumer, you may also bring it before the court of the place where you lived when the contract was concluded or when the harmful event occurred (Article R631-3 of the French Consumer Code).
